The Residences at Mandarin Oriental is the most prominent new condominium address in downtown Boca Raton. It is also, as of this writing, in serious financial and legal trouble. The facts are a matter of public record and trade reporting:
- A lender affiliated with Apollo Global Management filed a $417.7 million foreclosure suit against a Penn-Florida affiliate in roughly July 2026 - about $270 million in principal plus advanced project expenses, interest and fees.
- Alleged defaults include missed interest payments from June 2024 through August 2025, failure to repay at the September 2025 maturity, and a missed February 2025 completion deadline.
- The complaint also alleges the hotel management agreement was terminated, which puts the Mandarin Oriental brand's future role at the property in question.
- Penn-Florida affiliates countersued for more than $500 million, alleging the lender manufactured the defaults by halting funding and then taking control of construction. A UCC auction was halted by a New York judge.
- At least 13 buyers have sued over missed completion deadlines. One won a $1.98 million judgment; another settled for $2.1 million. As recently as October 9, 2026, a buyer sued over a $1.23 million deposit on a $4.1 million residence contracted in January 2022 with an estimated December 2022 completion.
- The adjacent hotel is a separate entity that filed Chapter 11 in December 2025. It is structurally complete but has never opened.
- Completion is genuinely unresolved. Published estimates range from "summer 2026" to 2027 to "2030 or later." The project was originally targeted for 2017.
What this means for a buyer. Deposit exposure is the issue. In a Florida pre-construction contract, a portion of your deposit is typically held in escrow and a portion may be released to fund construction. If a foreclosure proceeds, the escrowed portion is generally recoverable; the released portion is considerably harder to get back. That is precisely what the buyer lawsuits are about.
I am not telling you the building is uninvestable. Distressed projects sometimes resolve, change hands and finish. I am telling you that this is a legal and financial question before it is a real estate question, and that you should not sign anything here without a Florida real estate attorney reviewing the current status of the litigation and the escrow terms of your specific contract. If you want to talk it through, call me.
By status
Under construction
Glass House Boca Raton - 28 residences, nine stories, 280 E Palmetto Park Road. From $3.5M, roughly $1,210 per square foot. Garcia Stromberg architecture and interiors, developed by Chasen Companies and ASG Development. Q4 2027. The smallest and least hotel-like of the downtown projects, and currently the most straightforward.
In litigation
The Residences at Mandarin Oriental - 105 E Camino Real, part of the Via Mizner development. Reported at 85 to 92 residences across 12 stories, depending on source; the developer has not published a current figure. Pricing is likewise disputed across sources. Where published prices and sizes can be paired, figures land roughly between $1,400 and $2,480 per square foot. SB Architects with HBA interiors; Jack Nicklaus golf course at the Via Mizner club. See the warning above before engaging with this project.
Seeking approvals
Mr. C Residences Boca Raton - 41 SE 4th Street, from $1.7M, two to three bedrooms. 133 residences across 12 stories on a 2.1-acre assemblage, reduced from an earlier 190-unit plan. Cipriani family branding, developed by Wexford Real Estate and Key International. As of late October 2026 the project was still working through city approvals, so treat the 2029 estimate as provisional. The sales gallery is at 36 SE 3rd Street.
The Residences at The Boca Raton - 501 E Camino Real, two to five bedrooms, pricing not published. Tied to The Boca Raton resort. Early stage.
Completed
Alina Residences - 200 SE Mizner Boulevard, from $6.8M, one to four bedrooms. Completed 2024. Finished product with no construction risk, no deposit exposure and no wait. Given what is happening three blocks away, that is worth more than it used to be.
Downtown Boca has five new projects and they are in five completely different situations - one delivered, one building cleanly, one in foreclosure, two not yet approved. Remaining availability is not published for any of them.

What matters when you buy pre-construction in Florida
- Register your broker on the first sales gallery visit. The gallery works for the developer. Developers in this market routinely welcome broker participation and pay the buyer's broker, so representation generally costs you nothing - but most require registration on your first visit. Walk in alone and you may lose it permanently on that building.
- Ask what happens to your deposit if the developer defaults. The Mandarin Oriental situation is the reason this is not a theoretical question in Boca Raton. Know which portion is escrowed and which may be released to construction, and get it in writing.
- The deposit schedule is the decision, not the finishes. Florida pre-construction deposits are staged across construction milestones. On a 2029 delivery that is a long commitment.
- Deposits sit in escrow, and Florida gives condominium buyers a rescission window after the condominium documents are delivered. Use it.
- Delivery dates move. Every date on this page is an estimate, and one project here has been estimating since 2017.
- Post-Surfside reserve and inspection rules hit older buildings far harder than new ones - one of the stronger arguments for buying new in Florida right now.
- Branded residences carry brand fees, and as Mandarin Oriental shows, a brand agreement can be terminated. Ask what happens to the branding if the management agreement ends.

Is the Mandarin Oriental Boca Raton in foreclosure?
Yes. A lender affiliated with Apollo Global Management filed a foreclosure suit of approximately $417.7 million against a Penn-Florida affiliate in mid-2026, alleging missed interest payments and a missed completion deadline. The developer countersued for more than $500 million. Separately, the adjacent hotel entity filed Chapter 11 in December 2025, and at least 13 buyers have sued over deposits. Completion timing is unresolved. Consult a Florida real estate attorney before contracting there.
What is the cheapest new construction condo in Boca Raton?
Mr. C Residences, starting at $1.7 million. The trade-offs are time and certainty: the project was still working through city approvals as of late October 2026, with an estimated 2029 delivery.
Which new Boca Raton condo is finished and move-in ready?
Alina Residences at 200 SE Mizner Boulevard, completed in 2024, from $6.8 million. It is the only delivered project among the five tracked here, which means no construction risk, no deposit exposure and no waiting.
How much do pre-construction condos cost in Boca Raton?
Entry pricing runs from $1.7 million at Mr. C Residences to $6.8 million at Alina Residences. Glass House starts at $3.5 million, which computes to roughly $1,210 per square foot - the clearest price-per-square-foot figure available in Boca, since the others either have not published unit sizes or have conflicting published figures.
Are there branded residences in Boca Raton?
Yes. The Residences at Mandarin Oriental carries Mandarin Oriental branding, though the hotel management agreement was reported terminated in the foreclosure complaint. Mr. C Residences carries Cipriani family branding. The Residences at The Boca Raton is tied to The Boca Raton resort. Glass House is deliberately unbranded.
Can I use my own realtor to buy new construction in Boca Raton?
Yes, and it generally costs you nothing - developers in this market typically welcome broker participation and pay the buyer's broker. The condition is registration: most require your broker to accompany or register you on your first visit to the sales gallery. Visit alone and you may lose representation on that building permanently.
